Introduction

In the following Terms and conditions wherever you find the term “order” it means any physical or digital products which we offer the users to buy from kazemfineart.com.

You are allowed to buy orders from kazemfineart.com website just by registering and logging in to your account. It is a mandatory part in order to provide the highest security level for both sides, the users and the artist, Kazem Mohseni as service provider. By logging in to your account, you will be able to save your ordering and shipping information in a safe user profile as well as being able to view and track your orders, having the list of your purchased products in a history category as well as downloadable links for digital products like eBooks or tutorial videos for unlimited time in a safe and secure profile. You can delete your account at any time you like.

An order is confirmed as “sold” from kazemfineart.com just when the user receives the order confirmation via email from our website after finishing the process of payment. The users will find their order in order list of their account by logging in to it as well (the orders which must be packed for shipping stay in PROCESSING until the shipping process is complete).

Price and Payment

The price payable for the artworks that you order is clearly set out on Our Website. The prices may change over time. We have this right to update the price of our artworks and products (increase or decrease according to specific times of the year). The actual prices at the time are what are shown at Kazem Fine Art Shop.

Our prices are in euro (€), the official currency of Germany as member of EU countries (eurozone).

Bank charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency other than Euro (€) will be borne by you. Prices include Germany value added tax (“VAT”).

Security of your credit card and other payment methods

We take care to make Our Website safe for you to use. Card payments are not processed through pages controlled by us. We use one or more online payment service providers who will encrypt your card or bank account details in a secure environment.

Foreign taxes and duties

If you are not in Germany, we have no knowledge of, and no responsibility for, the laws in your country.

You are responsible for purchasing products which you are lawfully able to import into your country.

You are responsible for the payment of import duties and taxes of any kind levied in your country.

You are responsible for the payment of any additional delivery charges arising from delays due to your late or incomplete payment of import duties and taxes of any kind levied in your country.

Shipping and Delivery

We are delighted to send our artworks worldwide with high quality packaging to ensure safe delivery. The shipping parcel includes the original artwork plus the Certificate of Authenticity, signed and sealed by the artist.

Packaging and Shipping time

All orders are wrapped and packed securely to prevent the artwork being damaged in delivery. Depending on the size of artwork it generally takes around 3 to 5 days due to safe packaging to prepare and post. We will notify you with tracking number as soon as it ships.

Time for delivery specified on the order is an estimate only and time shall not be of the essence. If we agree with you to deliver on a particular day or at a particular time, we will do our best to comply. But no time given is to be treated as contractual. So we are not liable to you for any inconvenience you incur on account of delayed delivery. The size and the weight of the product has effect on delivery time.

Shipping Costs

We offer Free shipping for shopping from Germany and EU countries. For the rest of the world the shipping cost will be added according to the location of the world during checkout. This price includes the post insurance. Therefore you don’t need to pay extra costs for shipping insurance.

“Restrictive measures, or sanctions, are one of the EU’s tools to promote the objectives of the Common Foreign and Security Policy (CFSP). These include safe-guarding the EU’s values, its fundamental interests and security; consolidating and supporting democracy, the rule of law, human rights and the principles of international law; preserving peace; preventing conflicts and strengthening international security” [1].

Following the restrictive measures of EU’s security policy, we cannot offer our services to specific countries which are in the list of European Union sanctions. Please check the EU Sanctions Map (the blue marked countries).

Shipping Services

depending on the size and the price of the artwork as well as the location of the world to ship, we ship our artworks via DHL international or UPS international with tracking number.

For the product sent by post we will send you a message by email to tell you when we have dispatched your order and include any tracking number or other relevant information. Artworks are sent at our risk until signed for by you or by any other person at the address you have given to us. You must ensure that someone is present to accept the delivery.  When your artwork arrive, it is important that you check immediately the condition. If the product have been damaged in transit, you must refuse the delivery and immediately contact us so that we can take appropriate action to minimize your inconvenience.

Pick up

We are happy for you to pick up your artwork locally from us provided you make an appointment in advance and payment has been received into our bank. In case of Cash on delivery, the payment will be done at our appointment. Please send us an email in order to arrange a pickup date at contact@kazemfineart.com or contact page.

If you pick up Goods from us then please:

  • Please bring suitable transport facility to carry the artwork safely to your address especially if the size of the artwork is large.
  • The artwork is at your rist from the moment it is picked up by you or your carrier from us. you agree that you are responsible for everything that happens after you take possession of the product.

Order cancellation and refund

The following terms apply to cancellation of your order:

Physical products (Shipping products)

If you have ordered a product from our website but you wish to change your mind, you may cancel your order before it is sent via post to your address. If you ask for cancellation after shipping your order, it goes to category of Return and Refund (read below). If your order is still not sent to your address, you have Right to Cancel it without giving us a reason, and without incurring any liability. You will receive full refund via the same payment method which you have paid minus the Fees for commercial transactions which will be reduced from the seller revenue (according to the buyer locations the fee prices are different, Germany, EU or out of EU countries). In order to cancel your order, please do the following process:

  • Click on the link button below to access Order Cancellation Form (available just for logged-in users).
  • Fill the required parts fields. attach any required documents if necessary (Example: Invoice PDF which you receive via email after purchase).
  • After sending the form we will reply you within 24 hours about confirming your cancellation request and refund process.

(We would like to remind that the cancellation process must be done before shipping the product; otherwise it goes to the process of Return and Refund which is separate from the Cancellation Rights).

Digital products (Downloading products)

For digital products like videos or eBooks which are downloadable, user receives download link after finishing purchase process directly via email as well as it will be automatically stored in your order list of your account. Therefore we regret that there is no cancellation and refund possibility after ordering these products.

Return and Refund

Kazem is doing his best to assure that you are happy with your artwork. But if for any reason you aren’t, you can return it within 30 days of delivery, undamaged, for a refund minus any shipping costs as well as the Fees for commercial transactions (for more information about transaction fees please refer to Order Cancellation above). You are responsible for the cost of re-packing and returning the Goods including insurance in transit. Of course if your payment is Cash on Delivery, You will receive full refund without any transaction fees.

In order to return your order, please do the following process:

  • Click on the link button below to access Order Return Form (available just for logged-in users).
  • Fill the required parts fields. attach any required images or documents if necessary.
  • Write in detail the reason why you wish to send the artwork back.
  • After sending the form we will reply you within 24 hours about confirming your return request (please note that the refund process starts after receiving the product back from you).
  • Package the artwork securely in its original packaging or a similar secured package.
  • The artwork must be sent back by tracked delivery and is your responsibility until it arrives. Please provide us the tracking number via email to contact@kazemfineart.com.
  • Please send the artwork back to the same seller address which you find in your invoice.

Liability for subsequent defects

  1. Please examine the artwork received from us immediately you receive it. If you do not tell us of any defect or problem within 30 days of receipt of the Goods, we shall assume that you have accepted it.
  2. We will not accept as a defect any damage or degradation to any product caused after delivery to you:
    • by you or your contractor during assembly or framing of the artwork.
    • by your failure to take appropriate and reasonable care of or precautions with the artworks, whether mounted, framed, hung, worn etc.
    • by you because of not protecting the artwork from moisture, direct sunlight, dust or any physical or environmental effects on the product.
